There are two types of arbitration: binding and non-binding.
Non-binding arbitration is similar to mediation, except the arbiter can make decisions regarding your case. If the parties disagree with those decisions, you can still go in front of a judge.
Binding arbitration is similar to a trial. The arbiter is able to make decisions regarding your case but those decisions are final.
In domestic relations cases, arbitration is available if both parties agree. When one party decides to arbitrate, they must send notice of their intent to the opposing party.
Arbitration gives the opposing parties the ability to settle their dispute outside of court. This will keep costs low and decrease the amount of time required to settle the dispute. Opposite of attending a hearing with a judge in a courtroom, parties have slightly more say in who their arbitrator will be.
